In addition to that, this Visage Technologies Website Notice on Personal Data Processing (“Notice”) will inform You of the following matters You need to be aware of regarding the processing of Personal data when You browse or otherwise use this Website:

The Visage Technologies’ General Notice on Personal Data Processing (“General Notice”) shall apply to matters not regulated under this Notice. In case of inconsistencies, the provisions of this Notice shall prevail.

Visage Technologies reserves the right to update this Notice from time to time. Any use of this Website is subject to the Notice in force at the time of the use. The date of the last update to the Notice is visible at the top.

1.    Interpretation

We’ve made efforts to make this Notice clear and easy to read. If You have any doubts about the meaning of certain terms or conditions, the rules for interpretation specified below in Section 15 should help You.

If You still have doubts, don’t hesitate to contact our DPO, and we will clarify what is needed.

2.    Definitions

When reading this Notice, You already have and will encounter some terms that begin with a capital letter or are frequently repeated.

To ensure You have a clear, consistent, and precise understanding of key terms used herein, below in Section 16 You may find their list and definitions. 

3.    Scope of Application

This Notice is relevant to You if You are a natural person/Data subject pursuant to Applicable laws.

By accepting this Notice, You confirm that You are 16 years or older.

If Your age is below the age of 16, You can use this Website only if and to the extent that this Notice is accepted by the holder of parental responsibility.

4.    Data Controller

The company Visage Technologies d.o.o., having its seat in Zagreb, Ulica Ivana Lučića 2a, Croatia, personal identification number (OIB): 11883765066 (or Visage Technologies Croatia) is the Data controller with respect to the Personal data processed via this Website.

Some of the links on this Website refer to other websites (LinkedIn, Twitter, Instagram, Facebook, YouTube). If You decide to visit those websites, note that they might be considered a separate Data controller that independently determines the purposes for which your Data will be processed. We suggest You inform Yourself of the privacy policies of those third-party websites.

5.    How do we use Your Personal data?

Your Personal data is processed only when it is necessary and when there is an appropriate legal basis under the provisions of the Applicable laws.

We treat all Personal data as confidential information and a trade secret.

5.1.  How is Your Personal data collected when You visit this Website?

When You browse and use this Website, Your Personal data is collected through five separate channels:

  • the Personal data You give us when You contact us via the Website’s contact form,
  • the Personal data collected via “Cookies” (explained in Section 9),
  • the Personal data collected via Website tools (explained in Schedule 2),
  • the Data you give us through the “Careers” section of this Website when You submit an open application or application to our open job positions.
  • when You use our Demo on the Website, and
  • when You subscribe to our newsletter.

5.2.  What are the categories of Your Personal data that are collected when You visit this Website?

The following Personal data of the users and visitors of this Website, including You, are collected:

(i)              When You contact us via Website’s contact forms, we collect the following Personal data:

  • Your first and last name,
  • Your business e-mail and phone number,
  • the name and country of Your company,
  • Your interest in Visage Technologies products.
  • Also, note that the things You write in the Website contact form’s section “Briefly describe Your project”, can also constitute the Personal data You make available to us. As we don’t have control over what You will write there, we want You to know that we are aware of this and whatever You write, Yor eventually shared Data will be safe. We will still process only the Data that is covered by the legal basis for our Data processing described below.

(ii)              Besides the Personal data that is collected via Website’s contact forms, we also collect “Cookies”.

  • With “Cookies”, we collect user IP addresses, browser information, language, operating system, and other standard information required for the statistical analysis of website visitors.
  • Read more on how we use cookies in Section 9.

(iii)              When You submit an open application or application to our open job positions, we collect the following Data:

  • Your first and last name,
  • Your e-mail and phone number,
  • the Data You provide us with through your Resume (CV) and Cover Letter.
    • Also, note that we don’t have control over what You will write in Your Resume (CV) and Cover Letter, but we want You to know that we will keep Your Data safe and process only the Data that is covered by the legal basis for our Data processing described in Section 4.3 and for the purposes described in Section 4.4 hereof.
    • The Data You provide in Your Resume (CV) and Cover Letter is generally optional and depends on what You would like us to know about You. The more we get to know You, the greater the chances that You will be considered as a potential candidate. We leave it up to You to decide what You will share.
    • However, we must emphasize that even if You provide such Data in Your Resume (CV) and Cover Letter, we will not do further processing of the Data, and neither will the selection process be influenced by Data that is not relevant or legitimate to be processed in employee selection, such as family status, age, gender, or other sensitive Data as race origin, sexual orientation, political or religious views etc. For possible exceptions to this rule, please see Section 4.3 (ii).

5.3.  Legal basis for Personal data processing

Personal data collected via this Website, we process on the following legal basis:

(i)              Consent. The legal meaning of the term Consent is explained in detail in the Glossary. Note that You can withdraw Your Consent at any time – see more details about Your rights as a Data subject in Section 13. We use Your explicit Consent for Data Processing in the following situations:

  • for certain types of Cookies (explained in detail in Section 9),
  • for certain types of Website tools (explained in Schedule 2),
  • when You subscribe to our newsletter via the link on the Website’s homepage, and when You click ☑️ when we ask You if You would like to receive free quarterly newsletter,
  • if You type “Yes” on the application to one of our open positions page of this Website when we ask You if You would like us to retain Your information for 48 months to contact You about future job opportunities in Visage Technologies.

(ii)              Fulfilling Your requests – replying to your contact. When You contact us via the Contact form, or when you submit an open application or application to our open job positions, we process the Data You give us so we can answer Your questions and execute necessary actions for that matter (for example, preparing contract documentation, executing the recruitment and selection process).). Please note the following:

  • When You submit an open application or application to our open job positions, you will find mandatory Data marked with a *, such as Your name, last name, contact info, Resume (CV), and Cover Letter. Such Data is mandatory because we cannot execute an employee selection process with an unidentifiable individual that cannot be contacted, or without a view of previous experiences and educational background.
  • In the employee selection process, Visage Technologies does not process Data that is not relevant or legitimate to be processed in employee selection, such as family status, age, gender, or other sensitive Data such as race origin, health, sexual orientation, political or religious views, etc. However, in certain situations, collecting such Data might be mandatory if there is a valid legal basis, for example – affirmative hiring of persons with disabilities. In the case of such a selection process, the legal basis for the processing of Data will be specified for that individual process.
  • Contact form. When You contact us via the Contact form, the Personal data You enter is mandatory. Please note that the Contact form is primarily a business communication channel. Therefore, we need Your name, last name, and email address to know who we are communicating with and to be able to contact You. Further Data, such as Your interests and project description, we also need so we can understand Your inquiry and be able to give You the information You require. Data such as Your company info and country are relevant so we can have a better understanding of Your industry and how our technology might be relevant to it. Note that collecting that Data is also covered with our Legitimate interests explained below to be aware of who is contacting us and to assess whether the inquiry has fraudulent or otherwise malicious intent.

(iii)              Fulfilling Your requests – providing You the Demo. Our Demo processes Personal data only during the session. Also, it processes only the Data that is necessary for the Demo to showcase its functionalities, so it cannot perform without the concerned Data. You can learn more about Demos in Section 7.

(iv)              Achieving our Legitimate interest. The legal meaning of the term Legitimate interest is explained in detail in the Glossary. We have a Legitimate interest in processing Your Data in the following situations.

  • for certain types of Website tools (explained in Schedule 2),
  • When You contact us via the Contact form, You provide us with Your e-mail address. We use that e-mail address to send You our direct marketing materials to promote (only) our products and services. Our Legitimate interest is based on the Applicable laws (i.e. Article 50. Paragraph 2. of the Croatian Electronic Communications Act, Article 13. Paragraph 2. of PECR). You can always object to such processing and request us to stop sending You direct marketing messages, as explained in detail in Section 13. 
  • Taking actions that fall within the scope of our business relationship with You.
  • Preventing or detecting fraud or other illegal actions directed against us, our clients, or other persons.
  • Functioning, maintenance, upgrading, and development, and ensuring the security of the Website.
  • Developing, upgrading, and improving our products and services.
  • Supporting our legal claims, resolving Your complaints and claims i.e., defending our company from Your legal claims against us.
  • Safeguarding and protecting our company and its assets.

(v)              Compliance with our legal obligations. Processing of Your Data can be necessary for us to fulfill our legal obligations, for example, the obligations prescribed by criminal law, tax law, or fulfilling our duties in case of supervision or other proceedings initiated by competent court or administrative where we could be obliged to provide Data.

6.    Why do we process your Personal data (purposes)?

We process the Personal data we collect by this Website for the following purposes:

  • fulfilling Your requests,
  • new employee recruitment and selection,
  • communicating, maintaining, and developing our relationship with You,
  • giving You information about Visage Technologies, its services, and products,
  • sending You marketing materials based on Your communication preferences,
  • maintaining the Website, upgrading, and developing it, personalizing it, and gaining an understanding of how it is used so that we can improve it. We do that to ensure the wider reach and visibility of Visage Technologies’ products and services to markets worldwide,
  • undertaking surveys and questionnaires. Your opinion is critical to us. We want to know if You are satisfied with our products and services and if You think there is room for improvement. Participation in these surveys is voluntary as is the registration of Personal data in the questionnaires.
  • Solving inquiries and complaints. To answer all Your inquiries or complaints we need Your information, such as your name, surname, and e-mail address so that we can contact You. If You contact us with Your inquiries, the information You provide us with will be processed so that we can answer and solve Your problem.
  • Other purposes, but only with Your Consent.

7.    What about our live Demos?

Our Demos or live demonstration tool enables You to check out and discover some of our technology’s many possibilities and try out our products’ main functionalities.

When You use the Demo, Your following Personal data is processed temporarily (only during the session):

(i)              Facial Image During the Session.  Facial image is Personal data. To be able to provide its outputs, Demo needs and will ask for access to the camera on Your device.

  • Demo will analyze Your facial image, provide output based on the result of the analysis. Demo does not process biometric Data and is not intended to identify You.
  • After Your session with Demo is done, we no longer have access to the facial image.

(ii)             Cookie. A Cookie is stored on Your device, with the purpose of counting unique users. Be aware that by identifying unique users, we don’t identify You by name, but for example “user 01”.

●      From the Cookie, we get Your:

  • UserID that is free from Data that directly identifies You, i.e. it is anonymous,
  • SessionID that holds a session together, but is free from Data that directly identifies You, i.e. it is anonymous.

●      In theory, Cookies are Personal data because they can be traced back to You with appropriate and complex technical processes. But we don’t use this Cookie for such a purpose.

●      This Cookie is needed for the performance of Demo and is not used for third-party services, marketing, or any further processing outside the performance of the Demo.

(iii)            IP Address. The IP address of Your device is automatically collected by Demo when You open it. This is an unavoidable consequence of using website widgets, and this is needed for Demo to be able to work and provide outputs to You. It is required for HTTP requests that get information from the backend.

●      In theory, IP addresses are Your Personal data because they can be traced back to You. But we don’t use Your IP addresses for such a purpose.

●      We have no particular interest in processing Your IP address in a way to determine Your identity. The IP address is deleted as soon as possible.

8.    Do we share Your Personal data?

In certain situations, Your data can be shared with other entities.

  • The Data collected via “Cookies” is collected by Google Analytics for the purpose of better understanding the needs of users, improving products and services, and providing users with full functionality and quality content by using cookies from our websites. The Personal data collected via “Cookies” are transferred to the United States of America.
  • Some of the Cookies used by this Website are used by LinkedIn, according to LinkedIn’s policies. In that sense, LinkedIn might be considered as a separate Data controller that determines independently the purposes for which Your Data will be processed. We suggest You inform Yourself on LinkedIn’s Policy and Cookie Policy.
  • The Data collected via contact forms and job applications are, to a limited extent, shared with Visage Technologies Sweden on a need-to-know basis. The purpose of this sharing is the performance of regular business activities of Visage Technologies. For example, You might be contacted by our sales staff from Visage Technologies Sweden, or key staff from Visage Technologies Sweden might review Your CV on a need-to-know basis. However, all key decisions and processing activities (such as keeping) are performed in Visage Technologies Croatia.
  • The Data collected via the Website might be visible to our trusted contractual partners that undertake website maintenance. They are our Data Processors (a term also explained in the Glossary) with which we’ve entered into data processing agreements to ensure that the Data is safe and that our Data processors refrain from any actions that involve unlawful meddling with Your Personal data.
  • Data collected via the Contact form we manage by using the Salesforce platform, thereby investing efforts to keep the Data safe. For more information, we advise You to check Salesforce Privacy Information.
  • Also, if we are ordered by a court or other competent authority and required by law to disclose Your Data, it might be disclosed to such competent authorities.

9.    How do we process Cookies?

To ensure the proper functioning of our site and to improve its content browsing, we save a small number of cookies on Your computer. An exceptionally large number of websites use these tools in accordance with the Applicable laws.

Before You save cookies to Your computer, via the Cookie Banner, we ask for Your Consent or Your selection of preferences. You can adjust Your preferences at any time.

9.1.  What is the role of cookies?

The role of cookies You are allowed to be stored on Your computer is to save Your preferences, website settings, Your preferred language, or Your address. When You visit the same page again after a while, the internet browser You are using sends You information tailored to Your needs.

Depending on the defined task, cookies store a wide range of information, including Personal data. However, You decide which information the cookies will store. In Your browser settings, You can choose if You want to approve or reject cookies requests. By disabling cookies, You may not be able to use some of the functionalities of the pages You visit.

9.2.  Types of cookies

Permanent cookies remain on Your computer after the Internet browser is closed. Permanent cookies will remain on Your computer or mobile device for days, months, or even years and have the purpose of storing permanent information such as Your username and password so You do not have to re-apply each time You visit the page. This page uses cookies to improve user experience, to make sure that the page functions in the context of security and for the purposes of actions the site visitor chooses independently (web form for sending messages or searching for services).

  • Technical cookies are necessary for the website’s functioning and cannot be shut down. Usually, they are placed as a response to Your actions, e.g. turning certain features of the website on or off, enabling certain services of the website to be provided etc. Such cookies do not collect data that can identify You. As this Website cannot function without such cookies, we do not seek Your Consent for such cookies and You accept them if You want to use this Website.
  • Temporary (Session) cookies disappear from the computer after You close the Internet browser. With the help of cookies, temporary data, such as the data You provide when You are online, is stored.
  • First-party cookies can be permanent or temporary and store the information You will use again when visiting the pages from which they are stored on Your computer.
  • Third-party cookies or so-called advertising cookies are stored on Your computer if You use ads on the page, You are visiting, and this page redirects You to a third party. This mode serves to monitor the use of the Internet for marketing purposes.
  • Temporary cookies are deleted when You leave the Internet browser. Their only purpose is to enhance the user experience while visiting the site.
  • Permanent cookies have no restrictions and remain in Your browser until You manually delete them. The collected data are used for statistical purposes only.

Please note that cookie technology is rapidly evolving and there is a possibility that Schedule 1 is not perfectly up to date, despite our reasonable efforts to make it so. We will do our best to update Schedule 1 at least on an annual basis.

9.4.  Legal basis for the processing of Cookies

Other than for the Technical Cookies, we process Cookies only with Your Consent. You can manage Your Consent by choosing Your preferences on the Cookie Banner.

9.5.  Site visits frequency measurement

Our site uses Google Analytics metering services, Google Signals, and Google Ads.

10. How long do we keep Your Data (Data Retention Policy)?

We retain Your Personal data only as long as it is justified and necessary or required or permitted by applicable laws.

  • The Cookie duration is determined by the technical nature of the Cookie itself. You can see how long particular Cookies remain stored in Schedule 1.
  • In line with our legitimate interests described under Section 6.4, we may retain Your Data until the relevant deadline for the statute of limitations provided by applicable laws expires, or until the reasonable purpose for which the Data is retained expires.
  • In certain situations, Visage Technologies could be obliged by applicable laws (for example tax laws) to keep certain documentation during the period provided by law. We will keep documents only as long as required by law.
  • The Data You give us through Your job application is stored for 48 months only if You give us Your explicit Consent to do so. If You withdraw Your Consent sooner, we will delete the concerned Dataupon Your withdrawal.

Regarding the Data collected through contact forms, after the purpose and acceptable duration of the processing of Your Data expires, we might retain business-relevant information, but Your Personal data will be erased.

11. How do we protect Your data?

In our business activities, we do our best to make sure that Personal data is safe. We do this by applying reasonable technical and organizational measures, for example:

  • Personal data is visible only to the employees of Visage Technologies on a need-to-know basis,
  • Personal data is stored on a trusted information infrastructure,
  • we expect a certain level of data security from our Data processors, and we ensure that through Data protection agreements,
  • we regularly update our data protection policies and procedures.

12. Are there any risks to Your data if You use this Website?

As the internet is an ever-evolving global network, using it always comes with certain risks. Regarding the Data You give us directly, we are doing our best to minimize the risks that we can reasonably control, as much as possible.

Also, note that the cookies shared with Google can be used for ad targeting and personalization, and improving Google’s products. By collecting Cookies, Google can learn about Your recent and frequent searches, location history, visited websites, used apps, viewed web content, and other data. For that reason, there might be certain risks associated with use of Google Analytics and the transfer of data to the USA.

This is why we ask for Your Consent to process such data. Also, note that we are doing our best to minimize risks associated with Google Analytics as much as we can, by minimizing the data shared and processing only what is relevant to our business.

13. What are Your rights as a Data subject?

For the avoidance of doubt, keep in mind that the rights explained below, refer to Your Personal data, not any data (e.g. anonymous aggregated statistical data that cannot be traced to You).

As a Data subject, You are entitled to the following rights:

(i)            right to access Your Personal data. You are entitled to know if Your data is processed by us and if so, access it or seek a copy of Your Data.

(ii)            right to Data rectification or update

(iii)            right to the erasure of Your Data, especially if

  • the Data is no longer necessary,
  • processing is unlawful,
  • You withdraw Your Consent,
  • such is mandated by law.

(iv)            right to restriction of Data processing:

  • if You claim that Your Data is incorrect, for a period enabling us to verify the accuracy of Personal data.
  • if the processing is unlawful, but You oppose the erasure of Your Personal data and request the restriction of their use,
  • if we no longer need Personal data for the purposes of the processing, but You require them for the establishment, exercise, or defense of legal claims, or
  • if You objected to the processing of Your Personal data based on legitimate interests, until we finish the legitimate interest assessment and balance test.

(v)            You have the right to withdraw Your Consent given to us at any time; however, this shall not affect the lawfulness of processing before the withdrawal.

(vi)            You have the right to object at any time to the processing of Your data for the purposes of direct marketing.

We will reply no later than one month from the date of receipt of Your request or query. Still, we may extend the deadline depending on the complexity of Your request or the number of requests received, for a maximum of additional two months. If Your request is evidently unjustified or excessive, or excessively repeated, we may charge a reasonable fee due to administrative costs or in extreme cases, refuse to comply with the request.

15. Rules of Interpretation

The rules for interpretation of this Notice are:

(i)              The headings of the sections in this Notice do not affect their interpretation.

(ii)             Reference to sections and items implies reference to sections and items of this Notice.  

(iii)            When a specific word is stated in the singular, it also implies its plural and vice versa, unless the context of this Notice clearly states otherwise.        

(iv)           References to regulations, contracts, agreements, or other documents imply all later changes to these sources unless expressly stated otherwise.

(v)             The words “including” or “in particular” imply that the list is not exhaustive.

(vi)           The word “any” or “all” is a term used to indicate that no limitation or specific selection is being made, thus encompassing the full range of possibilities and excluding possible exceptions that aim to circumvent the intent of this Notice.

(vii)          The word “in writing” means a permanent and tangible form, which includes relevant e-mail.

(viii)         When the word “written” is used against a document (e.g. agreement), this implies a paper or digital (e.g. pdf) document that is signed by legal representatives of a company or by an individual.

(ix)           When counting deadlines, the day of an action or event that triggers the deadline is not counted. The counting starts on the following day. If a deadline falls on a Saturday, Sunday, or public holiday in Croatia, it is extended to the next working day.

“Consent”  is defined under Article 4 (11) of the GDPR, and in a nutshell means a freely given, informed, clear, unconditional and explicit statement that you agree to something or accept something, in this case – processing of your Personal data. Consent as a legal basis for Data processing is valid only if it fulfills requirements from Article 7 of the GDPR.  
„Data Controller“  is defined under Article 4 (7) of the GDPR, and in a nutshell means a person that determines the purposes and means of the processing of Personal data.  
„Data subject“  is defined under Article 4 (1) of the GDPR, and means an identified or identifiable natural person.   If you are a natural person, you are a Data subject.  
“Data Processor”  is defined under Article 4 (8) of the GDPR, and means a natural or legal person, public authority, agency, or other body which processes Personal data on behalf of the controller – for the controller and based on the controller’s instructions.
„Personal data“ or „Data“  is defined under Article 4 (1) of the GDPR, and means any information relating to the Data subject, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.  
„You“ or “Yours”  means the natural or legal person that is reading this Notice and/or in any way using/browsing/visiting the Website.  
“Legitimate interest”  means the legitimate interest as a basis for the processing of Personal data as it is defined under the GDPR. In simple words, the Data controller has a legitimate interest to process Personal data e.g. when the processing is needed to carry out tasks related to business activities, provided that such legitimate interests do not seriously impact Data subjects’ rights, i.e., the Data subject’s rights do not prevail over the controller’s legitimate interest.  
“Need-to-know basis”  means that certain information or Data is disclosed only to the person that needs the Data or information to carry out tasks, during the concerned task, and only to the extent that is relevant for the concerned task.  
 „we“, „us“, „our“  means Visage Technologies.
“Visage Technologies”  means Visage Technologies Sweden and Visage Technologies Croatia are referred to collectively.
